Indeed. Although the driver compiled fine with the 2.6.26 kernel I use
it did not work correctly. Normal incoming and outgoing calls worked
fine the only problem I noticed has been the non functional call
deflection (and the broken capiinfo output).

I found a fritz driver version which seems to be patched to work with
later 2.6.2x kernels.

This driver fixes the call deflection problem and capiinfo output now
looks correct again.
